1. ABOUT GOBUY
GoBuy is a phone retail service operated by GoBuy CI SARL / GoCab225 ("GoBuy", "we", "us") that allows eligible customers to purchase smartphones and pay in instalments. GoBuy is not a bank, financial institution, or credit provider. GoBuy offers deferred-payment commercial sales governed by the laws of Côte d'Ivoire and applicable OHADA Uniform Acts.
2. ELIGIBILITY
To use the GoBuy service, you must:
- Be at least 18 years of age.
- Be a resident of Côte d'Ivoire with a valid national ID (CNI) or passport.
- Hold an active mobile money account (Wave, Orange Money, or MTN Money).
- Provide accurate personal information, including proof of address and an emergency contact.
- Pass GoBuy's customer eligibility review, which GoBuy reserves the right to conduct at its sole discretion.
3. THE INSTALMENT SALE — HOW IT WORKS
When you place an order through the GoBuy app:
- You are purchasing a phone at a fixed total price. This is a commercial sale, not a loan or credit agreement.
- You pay the total price in instalments over a schedule agreed at the time of purchase. No interest is charged. The price displayed in the app is the total and final price you will pay.
- GoBuy retains ownership of the phone until you have paid the full price. You become the legal owner only upon receipt of your final instalment payment.
- You may not sell, lend, pledge, or transfer the phone to any third party before completing all payments.
4. PAYMENTS
- Payment methods: All instalment payments must be made through the payment methods available in the app (Wave, Orange Money, MTN Money, or bank transfer).
- Payment schedule: Your payment schedule is confirmed at the time of purchase and displayed in your GoBuy account. You are responsible for ensuring payments are made on the due dates.
- Late payments: A payment is considered late if not received within 7 calendar days of the due date. GoBuy will notify you by SMS or in-app notification before any account action is taken.
- No hidden fees: The total price displayed at purchase is the only amount you owe. GoBuy does not charge interest, late fees, or any additional cost on top of the agreed sale price.
5. MOBILE DEVICE MANAGEMENT (MDM)
By accepting these Terms, you expressly consent to the installation and operation of a Mobile Device Management (MDM) application on the phone you purchase from GoBuy, for the duration of your payment plan.
The MDM application:
- Is installed during the mandatory onboarding session before the phone is handed to you.
- Allows GoBuy to verify device location at delivery.
- May restrict phone functionality if a payment is 7 or more days overdue, following prior SMS notification to you. Basic calling functionality is maintained at all times.
- Does NOT access your personal data, messages, contacts, photos, browsing history, or any other private content.
- Is permanently uninstalled from the device automatically upon receipt of your final payment.
Important: Attempting to remove, disable, or circumvent the MDM application constitutes a material breach of your purchase agreement and may result in repossession of the device.
6. DEFAULT AND REPOSSESSION
You will be considered in default if:
- Two consecutive instalment payments are not received by their due dates, or
- One payment is more than 21 days overdue despite two prior written notifications from GoBuy.
In the event of default, GoBuy may:
- Fully restrict the phone via MDM, following a 72-hour prior written notice sent to your registered contact.
- Recover the phone, as GoBuy remains the legal owner under the retention-of-title clause agreed at purchase. This is not a seizure — it is the recovery of GoBuy's own property, exercised under the OHADA Uniform Act on Securities.
- Retain all payments already received as compensation for the use of the device and its depreciation during the period of use.
GoBuy will always attempt to reach an amicable payment arrangement before taking any enforcement action.
7. ACCOUNT & APP USE
- You are responsible for maintaining the security of your GoBuy account credentials. Do not share your login details or OTP codes with anyone.
- GoBuy reserves the right to suspend or terminate your account in the event of fraudulent activity, provision of false information, or material breach of these Terms.
- You must promptly update your contact information in the app if it changes.
- The GoBuy app is for personal use only. You may not use it on behalf of a third party or for commercial resale purposes.
8. INTELLECTUAL PROPERTY
All content on the GoBuy app — including the name, logo, interface design, and product images — is the property of GoBuy CI SARL. You may not copy, reproduce, distribute, or use any part of it without prior written consent from GoBuy.
9. PERSONAL DATA & PRIVACY
GoBuy collects the following data to operate the service: name, phone number, identity document, address, mobile money account details, and device IMEI. This data is used exclusively to manage your purchase contract, process payments, and prevent fraud. GoBuy does not sell your personal data to third parties.
The MDM application collects only device status and location at delivery. It does not access personal content on the device. All data is stored securely and retained for a maximum of 5 years after the end of your contract.
You have the right to access, correct, or request deletion of your personal data at any time by contacting legal.gobuy@goca.io.

GoBuy commits to responding to all complaints within 2 business days. If your complaint is not resolved within 14 days, you may refer the matter to the Direction Générale de la Concurrence, de la Consommation et de la Répression des Fraudes (DGCCRF) in Abidjan.
11. LIMITATION OF LIABILITY
GoBuy is not liable for: (i) any indirect or economic loss arising from a phone malfunction covered by the manufacturer's warranty process; (ii) loss of data stored on the device; (iii) service interruptions of mobile money providers used for payments. GoBuy's maximum liability to a customer under these Terms is limited to the total price paid by that customer for the device.
12. CHANGES TO THESE TERMS
GoBuy may update these Terms from time to time. You will be notified of any material changes in the app and by SMS at least 14 days before the changes take effect. Continued use of the app after that date constitutes acceptance of the updated Terms.
13. GOVERNING LAW & DISPUTES
These Terms are governed by the laws of Côte d'Ivoire and the applicable OHADA Uniform Acts. Any dispute that cannot be resolved amicably within 30 days shall be submitted to the exclusive jurisdiction of the Tribunal de Commerce d'Abidjan.
